Terms and Conditions


These Terms and Conditions establish general terms governing the purchase of Products on the Diana Restu website (hereinafter referred to as the "Terms and Conditions").


Buyers must read and agree to the contents of these Terms and Conditions before making a purchase transaction on Diana Restu. If the Buyer does not agree to these Terms and Conditions, it is strongly recommended not to proceed with the purchase on Diana Restu.


By making a purchase transaction on Diana Restu, the Buyer signifies agreement with the Terms and Conditions, declaring to be bound by the Agreement with the Online Store and the Terms and Conditions.


A.Definitions


  1. Diana Restu: A sole proprietorship/CV/limited liability company trading under the name Diana Restu.
  2. Diana Restu Website: Where Diana Restu displays Products and Prices for sale to Buyers.
  3. Products: Goods sold on Diana Restu as listed in the product catalog on the Diana Restu website.
  4. Prices: Prices in Indonesian Rupiah for each Product sold on Diana Restu.
  5. Agreement: The agreement between the Buyer and Diana Restu regarding the Products and Prices that occurs when the Buyer agrees to purchase a Product by submitting the Order Form, and Diana Restu sends a confirmation that the Order has been received. In the Agreement, the Buyer must pay the Price, and the Online Store must deliver the Product.
  6. Order Form: The form that the Buyer must fill out to order purchased Products, containing details such as the Buyer's Name, Address, Phone Number, Product (including quantity, color, and type), Payment Method, and Delivery Method automatically generated by the system for the Buyer before completing the purchase.
  7. Order: The Products to be purchased by the Buyer, including quantity, color, type, and Price.


B. Products and Prices


  1. Products and information or complete descriptions of the Products (including but not limited to color, quality, functionality, etc.) displayed on the Diana Restu website are accurate, true, and in accordance with the actual conditions. Color differences may occur depending on the Buyer's computer/tablet/phone monitor.
  2. The Buyer acknowledges that the actual color of the Product as seen on the Diana Restu site depends on the Buyer's computer/tablet/phone monitor. Diana Restu has made the best efforts to ensure that the colors in the photos displayed on the Diana Restu site appear as accurately as possible, but cannot guarantee that the color appearance on the Diana Restu site will be entirely accurate.
  3. The Prices displayed on the Diana Restu site are accurate and applicable at the time the price is listed. Prices may change at any time; however, changes will not affect Orders already confirmed by Diana Restu. The Buyer will only pay the Price listed in the confirmed Order Form.
  4. Diana Restu is responsible for the availability of all Products displayed on the Diana Restu site. If Product stock is unavailable or depleted, Diana Restu will specify that the Product is unavailable or sold out.
  5. Regarding availability, Product stock may change at any time. In the event of out-of-stock Products, Diana Restu reserves the right to reject Orders from the Buyer, and payment for the relevant Product will be refunded to the Buyer.
  6. The Buyer is required to read, understand, and agree to the entire information/description of the Products (including but not limited to color, quality, functionality, etc.) and Prices before making an offer or commitment to purchase by completing the Order Form.


C. Ordering Process


  1. The Buyer is deemed to have understood, acknowledged, accepted, and agreed to the Products and Prices as well as the description and condition of the Products when the Buyer submits the Order Form to the Seller.
  2. Diana Restu will send an Order acceptance notification to the Buyer stating that the Order has been received, a summary of the Order, and payment instructions for the Buyer.
  3. If the Buyer finds errors in the data entered in the Order Form, the Buyer can immediately contact the Online Store through the chat feature or the number provided on the website.
  4. The Buyer and Diana Restu are legally bound by the Agreement when Diana Restu sends the Order acceptance notification.
  5. Unless the Buyer chooses the Cash On Delivery (COD) payment method, the payment completion deadline is provided according to the information specified at the time of purchase. If there is no payment after this period, the Order is automatically canceled. For COD shipments, the Order will be delivered after Diana Restu notifies the Buyer that the Order is being processed.
  6. After the Buyer makes the payment and Diana Restu confirms the receipt of payment, Diana Restu will notify the Buyer that the Order will be processed soon.
  7. Diana Restu will notify the Buyer when the Order is being shipped and in the process of delivery until the Order arrives at its destination.
  8. The delivery area coverage depends on the availability of couriers, which can be checked on the website.


D. Payment


  1. Payment is made by the Buyer in Indonesian Rupiah (IDR).
  2. Order payments can be made through credit cards, debit cards, bank transfers, e-banking, mobile banking, OVO, ShopeePay, payments at AlfaMart, Paylater (Akulaku), or Cash On Delivery ("COD"). Direct bank transfers to the Online Store's account number listed on the website are also accepted.
  3. Payment is considered complete when the amount received by Diana Restu matches the specified amount in the Order Form. Buyers are expected to promptly confirm payments through the "Payment Confirmation" feature on the Diana Restu website or by contacting us through the chat feature.
  4. Diana Restu is not responsible for delays or rejections in bank transfer processes, issues with ATMs, credit card or debit card rejection, problems in the OVO, Akulaku, and/or ShopeePay payment systems. In such cases, Buyers may contact the respective bank, credit card provider, or payment service provider.
  5. Diana Restu is not liable for Buyer negligence in providing the correct name and account number for Diana Restu or any inaccuracies in transfer information or bank errors during the payment process.
  6. For COD payments, Buyers will pay in cash the amount specified in the Order Form directly to the delivery service personnel during the product handover.
  7. For each payment method, the Buyer will incur administrative fees as follows:
  • Credit Card/Debit Card: 1.5% of the Transaction Value*
  • OVO: 1% of the Transaction Value*
  • ShopeePay: Rp 0
  • Convenience Store (AlfaMart, Indomaret): Rp.2,500
  • Bank Transfer (ATM, e-banking, e-mobile): Rp.0
  • Paylater (Akulaku): 1% of the Transaction Value*
  • COD: 3% of the Transaction Value*


*Transaction Value is the Product Price + Shipping Fee



E. Buyer Protection Period


  1. Upon receiving the Order, the Buyer must immediately inspect the condition of the Product and ensure the accuracy, quantity, and quality of the received Product.
  2. If the Order received by the Buyer is incorrect, please contact the Seller directly through the chat feature for further resolution through the contact provided on the website.


F. Complaint Submission


We always check and ensure the quality and quantity of the Products according to the Order Form approved by the Buyer before shipment. However, if the Buyer has complaints such as manufacturing defects, damaged products, expired products, or Products not matching the Order Form, the Buyer can submit a complaint via the chat feature, and we will be happy to assist with the Buyer's issue.


G. Dispute Resolution


  1. Any disputes or disagreements arising from the Terms and Conditions, Agreement, legal relationship between the Buyer and Diana Restu will be resolved primarily through mutual consultation.
  2. In case mutual resolution cannot be achieved, the parties agree to settle the dispute in the State Court according to the defendant's jurisdiction.


H. Applicable Law


The Terms and Conditions, Agreement, legal relationship between the Buyer and Diana Restu, and all legal consequences related to the use of the Diana Restu website and purchase transactions on Diana Restu are governed and interpreted by the laws of the Republic of Indonesia.


I. Customer Service

Diana Restu is committed to providing the best service to customers. If customers encounter difficulties using the Diana Restu website, have questions, comments, or suggestions, customers can contact us through the chat feature or email.


REPORTING INTELLECTUAL PROPERTY VIOLATIONS


If you are the owner of intellectual property rights ("Pemilik HAKI") or an agent authorized by the IP Owner ("Agen HAKI") and believe that your rights or the rights of the party you represent have been violated by any listings in this store, please inform us directly in writing through Intellectual Property Infringement and provide the required documents below to support your claim. Please allow us time to process the information provided. This store will respond to your claim as soon as possible.


Claims under this section must be provided in the form specified below, which may be updated from time to time, and must include at least the following:

  • The physical or electronic signature of the person submitting the complaint ("Informant").
  • An explanation of the type and nature of the intellectual property rights allegedly violated.
  • Details of the list containing the alleged violations.
  • Sufficient information for us to contact the Informant, such as a physical address, telephone number, and email address of the Informant.
  • A statement by the Informant that the complaint is filed in good faith and that the use of the intellectual property rights as identified by the Informant is not authorized.
  • A statement by the Informant that the information in the notice is accurate, indemnify us for any losses suffered by us as a result of the information provided by the Informant, and that the Informant has appropriate rights or authorization to act on behalf of the "Pemilik HAKI" for the complaint.



Syarat dan Ketentuan


Syarat dan Ketentuan ini menetapkan ketentuan umum yang mengatur pembelian Produk di situs web Diana Restu (selanjutnya disebut "Syarat dan Ketentuan").


Pembeli harus membaca dan menyetujui isi dari Syarat dan Ketentuan ini sebelum melakukan transaksi pembelian di Diana Restu. Jika Pembeli tidak setuju dengan Syarat dan Ketentuan ini, sangat disarankan untuk tidak melanjutkan pembelian di Diana Restu.


Dengan melakukan transaksi pembelian di Diana Restu, Pembeli menandakan persetujuan terhadap Syarat dan Ketentuan, menyatakan bahwa dia terikat oleh Perjanjian dengan Toko Online dan Syarat dan Ketentuan.


A. Definisi


  1. Diana Restu: Perusahaan perseorangan/CV/perusahaan dengan tanggung jawab terbatas yang berdagang dengan nama Diana Restu.
  2. Situs Web Diana Restu: Tempat Diana Restu menampilkan Produk dan Harga untuk dijual kepada Pembeli.
  3. Produk: Barang yang dijual di Diana Restu sebagaimana tercantum dalam katalog produk di situs web Diana Restu.
  4. Harga: Harga dalam Rupiah Indonesia untuk setiap Produk yang dijual di Diana Restu.
  5. Perjanjian: Perjanjian antara Pembeli dan Diana Restu mengenai Produk dan Harga yang terjadi ketika Pembeli setuju untuk membeli Produk dengan mengirimkan Formulir Pemesanan, dan Diana Restu mengirimkan konfirmasi bahwa Pesanan telah diterima. Dalam Perjanjian, Pembeli harus membayar Harga, dan Toko Online harus mengirimkan Produk.
  6. Formulir Pemesanan: Formulir yang harus diisi oleh Pembeli untuk memesan Produk yang akan dibeli, berisi rincian seperti Nama Pembeli, Alamat, Nomor Telepon, Produk (termasuk jumlah, warna, dan jenis), Metode Pembayaran, dan Metode Pengiriman yang dihasilkan secara otomatis oleh sistem untuk Pembeli sebelum menyelesaikan pembelian.
  7. Pesanan: Produk yang akan dibeli oleh Pembeli, termasuk jumlah, warna, jenis, dan Harga.


B. Produk dan Harga


  1. Produk dan informasi atau deskripsi lengkap Produk (termasuk namun tidak terbatas pada warna, kualitas, fungsionalitas, dll.) yang ditampilkan di situs web Diana Restu akurat, benar, dan sesuai dengan kondisi sebenarnya. Perbedaan warna mungkin terjadi tergantung pada monitor komputer/tablet/ponsel Pembeli.
  2. Pembeli mengakui bahwa warna sebenarnya dari Produk yang terlihat di situs Diana Restu tergantung pada monitor komputer/tablet/ponsel Pembeli. Diana Restu telah berusaha sebaik mungkin untuk memastikan bahwa warna dalam foto yang ditampilkan di situs Diana Restu muncul seakurat mungkin, tetapi tidak dapat menjamin bahwa tampilan warna di situs Diana Restu akan sepenuhnya akurat.
  3. Harga yang ditampilkan di situs Diana Restu akurat dan berlaku pada saat harga tercantum. Harga dapat berubah kapan saja; namun, perubahan tidak akan memengaruhi Pesanan yang sudah dikonfirmasi oleh Diana Restu. Pembeli hanya akan membayar Harga yang tercantum dalam Formulir Pemesanan yang dikonfirmasi.
  4. Diana Restu bertanggung jawab atas ketersediaan semua Produk yang ditampilkan di situs Diana Restu. Jika stok Produk tidak tersedia atau habis, Diana Restu akan menentukan bahwa Produk tidak tersedia atau habis.
  5. Terkait ketersediaan, stok Produk dapat berubah kapan saja. Dalam hal Produk habis stok, Diana Restu berhak menolak Pesanan dari Pembeli, dan pembayaran untuk Produk yang bersangkutan akan dikembalikan kepada Pembeli.
  6. Pembeli diharuskan membaca, memahami, dan menyetujui seluruh informasi/deskripsi Produk (termasuk namun tidak terbatas pada warna, kualitas, fungsionalitas, dll.) dan Harga sebelum membuat penawaran atau komitmen untuk pembelian dengan mengisi Formulir Pemesanan.


C. Proses Pemesanan


  1. Pembeli dianggap telah memahami, mengetahui, menerima, dan menyetujui Produk dan Harga serta deskripsi dan kondisi Produk ketika Pembeli mengirimkan Formulir Pemesanan kepada Penjual.
  2. Diana Restu akan mengirimkan pemberitahuan penerimaan Pesanan kepada Pembeli yang menyatakan bahwa Pesanan telah diterima, ringkasan Pesanan, dan petunjuk pembayaran untuk Pembeli.
  3. Jika Pembeli menemukan kesalahan dalam data yang dimasukkan dalam Formulir Pemesanan, Pembeli dapat segera menghubungi Toko Online melalui fitur obrolan atau nomor yang disediakan di situs web.
  4. Pembeli dan Diana Restu secara hukum terikat oleh Perjanjian ketika Diana Restu mengirimkan pemberitahuan penerimaan Pesanan.
  5. Kecuali Pembeli memilih metode pembayaran Cash On Delivery (COD), batas waktu penyelesaian pembayaran disediakan sesuai dengan informasi yang ditentukan pada saat pembelian. Jika tidak ada pembayaran setelah periode ini, Pesanan secara otomatis dibatalkan. Untuk pengiriman COD, Pesanan akan dikirim setelah Diana Restu memberi tahu Pembeli bahwa Pesanan sedang diproses.
  6. Setelah Pembeli melakukan pembayaran dan Diana Restu mengonfirmasi penerimaan pembayaran, Diana Restu akan memberi tahu Pembeli bahwa Pesanan akan segera diproses.
  7. Diana Restu akan memberi tahu Pembeli ketika Pesanan sedang dikirim dan dalam proses pengiriman hingga Pesanan tiba di tujuan.
  8. Cakupan area pengiriman tergantung pada ketersediaan kurir, yang dapat diperiksa di situs web.


D. Pembayaran


  1. Pembayaran dilakukan oleh Pembeli dalam bentuk Rupiah Indonesia (IDR).
  2. Pembayaran pesanan dapat dilakukan melalui kartu kredit, kartu debit, transfer bank, layanan perbankan elektronik, perbankan melalui ponsel, OVO, ShopeePay, pembayaran di AlfaMart, Paylater (Akulaku), atau Cash On Delivery ("COD"). Transfer langsung ke nomor rekening Toko Online yang tercantum di situs web juga diterima.
  3. Pengiriman Pembayaran dianggap lengkap ketika jumlah yang diterima oleh Diana Restu sesuai dengan jumlah yang ditentukan dalam Formulir Pemesanan. Pembeli diharapkan segera mengonfirmasi pembayaran melalui fitur "Konfirmasi Pembayaran" di situs web Diana Restu atau dengan menghubungi kami melalui fitur obrolan.
  4. Diana Restu tidak bertanggung jawab atas keterlambatan atau penolakan dalam proses transfer bank, masalah dengan ATM, penolakan kartu kredit atau kartu debit, masalah dalam sistem pembayaran OVO, Akulaku, dan/atau ShopeePay. Dalam hal tersebut, Pembeli dapat menghubungi bank, penyedia kartu kredit, atau penyedia layanan pembayaran yang bersangkutan.
  5. Diana Restu tidak bertanggung jawab atas kelalaian Pembeli dalam memberikan nama dan nomor rekening yang benar untuk Diana Restu atau ketidakakuratan informasi transfer atau kesalahan bank selama proses pembayaran.
  6. Untuk pembayaran COD, Pembeli akan membayar dengan uang tunai sejumlah yang tercantum dalam Formulir Pemesanan langsung kepada petugas layanan pengiriman selama penyerahan produk.
  7. Untuk setiap metode pembayaran, Pembeli akan dikenakan biaya administrasi sebagai berikut:
  • Kartu Kredit/Kartu Debit: 1,5% dari Nilai Transaksi*
  • OVO: 1% dari Nilai Transaksi*
  • ShopeePay: Rp 0
  • Toko Convenience (AlfaMart, Indomaret): Rp.2.500
  • Transfer Bank (ATM, perbankan elektronik, perbankan melalui ponsel): Rp.0
  • Paylater (Akulaku): 1% dari Nilai Transaksi*
  • COD: 3% dari Nilai Transaksi*


*Nilai Transaksi adalah Harga Produk + Biaya


E. Periode Perlindungan Pembeli


  1. Setelah menerima Pesanan, Pembeli harus segera memeriksa kondisi Produk dan memastikan ketepatan, jumlah, dan kualitas Produk yang diterima.
  2. Jika Pesanan yang diterima oleh Pembeli tidak sesuai, harap hubungi Penjual secara langsung melalui fitur obrolan untuk penyelesaian lebih lanjut melalui kontak yang disediakan di situs web.


F. Pengajuan Keluhan


Kami selalu memeriksa dan memastikan kualitas dan jumlah Produk sesuai dengan Formulir Pemesanan yang disetujui oleh Pembeli sebelum pengiriman. Namun, jika Pembeli memiliki keluhan seperti cacat manufaktur, produk rusak, produk kadaluarsa, atau Produk yang tidak sesuai dengan Formulir Pemesanan, Pembeli dapat mengajukan keluhan melalui fitur obrolan, dan kami akan senang membantu menangani masalah Pembeli.


G. Penyelesaian Sengketa


  1. Setiap perselisihan atau ketidaksetujuan yang timbul dari Syarat dan Ketentuan, Perjanjian, hubungan hukum antara Pembeli dan Diana Restu akan diselesaikan terutama melalui konsultasi bersama.
  2. Jika penyelesaian bersama tidak dapat dicapai, para pihak setuju untuk menyelesaikan perselisihan di Pengadilan Negeri sesuai yurisdiksi tergugat.


H. Hukum yang Berlaku


Syarat dan Ketentuan, Perjanjian, hubungan hukum antara Pembeli dan Diana Restu, dan semua konsekuensi hukum terkait dengan penggunaan situs web Diana Restu dan transaksi pembelian di Diana Restu diatur dan diinterpretasikan oleh hukum Republik Indonesia.


I. Layanan Pelanggan

Diana Restu berkomitmen untuk memberikan layanan terbaik kepada pelanggan. Jika pelanggan mengalami kesulitan menggunakan situs web Diana Restu, memiliki pertanyaan, komentar, atau saran, pelanggan dapat menghubungi kami melalui fitur obrolan atau email.


LAPORAN PELANGGARAN HAK KEKAYAAN INTELEKTUAL


Apabila Anda adalah pemilik hak kekayaan intelektual ("Pemilik HAKI") atau agen yang diotorisasi oleh Pemilik HAKI ("Agen HAKI") dan meyakini bahwa hak-hak Anda atau hak pihak yang Anda wakili telah dilanggar oleh produk yang terdaftar di toko ini, mohon beritahukan kami secara langsung secara tertulis melalui Pelanggaran Hak Kekayaan Intelektual dan sertakan dokumen-dokumen yang diperlukan di bawah ini untuk mendukung klaim Anda. Mohon berikan waktu kepada kami untuk memproses informasi yang diberikan. Toko ini akan merespons klaim Anda secepat mungkin.


Klaim di bawah bagian ini harus disampaikan dalam bentuk yang ditentukan di bawah ini, yang dapat diperbarui dari waktu ke waktu, dan setidaknya harus mencakup hal-hal berikut:

  • Pernyataan oleh Pemberi Informasi bahwa keluhan diajukan dengan itikad baik dan bahwa penggunaan hak kekayaan intelektual yang diidentifikasi oleh Pemberi Informasi tidak diotorisasi.
  • Pernyataan oleh Pemberi Informasi bahwa informasi dalam pemberitahuan tersebut akurat, memberikan jaminan kepada kami untuk setiap kerugian yang kami alami sebagai akibat dari informasi yang diberikan oleh Pemberi Informasi, dan bahwa Pemberi Informasi memiliki hak atau otorisasi yang sesuai untuk bertindak atas nama "Pemilik HAKI" untuk keluhan tersebut.
